2008年，浙江省積極推進知識產(chǎn)權(quán)戰(zhàn)略的實施，各級政府和有關(guān)部門進一步加大知識產(chǎn)權(quán)保護力度，知識產(chǎn)權(quán)工作的覆蓋率和顯示度大幅提升，呈現(xiàn)出持續(xù)發(fā)展的良好局面。
一、全面推進知識產(chǎn)權(quán)戰(zhàn)略的實施
浙江省人民政府先后頒布了《實施自主創(chuàng)新能力提升行動計劃》、《浙江省文化市場綜合行政執(zhí)法管理辦法》和《浙江省著作權(quán)管理辦法》，省級有關(guān)部門出臺了《知識產(chǎn)權(quán)、標(biāo)準(zhǔn)化、品牌戰(zhàn)略實施計劃》及《關(guān)于保護和促進浙江老字號發(fā)展的若干意見》等規(guī)定。同時增設(shè)省委宣傳部、檢察院等6部門為省知識產(chǎn)權(quán)領(lǐng)導(dǎo)小組成員單位，進一步健全了知識產(chǎn)權(quán)工作的協(xié)調(diào)機制。
二、進一步推進企業(yè)與區(qū)域知識產(chǎn)權(quán)工作
2008年，全省已累計認(rèn)定各級專利示范（試點）企業(yè)1656家，其中國家級示范（試點）企業(yè)13家。認(rèn)定杭州市西湖區(qū)等19個縣（市、區(qū)）為“浙江省知識產(chǎn)權(quán)工作示范創(chuàng)建縣（市、區(qū)）”，桐鄉(xiāng)經(jīng)濟開發(fā)區(qū)為“浙江省知識產(chǎn)權(quán)工作示范創(chuàng)建園區(qū)”。我省企業(yè)參與制定國際標(biāo)準(zhǔn)14項、國家標(biāo)準(zhǔn)438項、行業(yè)標(biāo)準(zhǔn)312項，全省累計有中國名牌289個，浙江名牌1660個。
三、加強知識產(chǎn)權(quán)文化建設(shè)
2008年，全省知識產(chǎn)權(quán)局系統(tǒng)全年投入宣傳經(jīng)費800余萬元，比上年增長10%。投入培訓(xùn)經(jīng)費600余萬元，比上年增長30%。舉辦知識產(chǎn)權(quán)培訓(xùn)441期，培訓(xùn)人員達(dá)4.15萬人次。知識產(chǎn)權(quán)的對外合作交流進一步發(fā)展。
四、加強知識產(chǎn)權(quán)保護工作
2008年，全省專利申請量89,965件，專利授權(quán)量52,955件，PCT申請177件。集成電路布圖設(shè)計專有權(quán)公告64項，并依據(jù)《浙江省專利保護條例》的有關(guān)規(guī)定，在部分縣（市、區(qū)）開展專利行政委托執(zhí)法工作。全省新增馳名商標(biāo)18件，新增商標(biāo)國際注冊7150件，新增注冊商標(biāo)4.8萬件。全省軟件版權(quán)登記數(shù)為4131件，新增5項地理標(biāo)志產(chǎn)品。制（修）訂11項地理標(biāo)志產(chǎn)品國家標(biāo)準(zhǔn)。專利部門開展了“雷雨”、“天網(wǎng)”專項行動，重點檢查會展、市場、超市等流通場所百余次，受理專利糾紛投訴150多件，正式立案44件，結(jié)案25件，非立案調(diào)處50余件。公安、檢察機關(guān)打擊侵犯知識產(chǎn)權(quán)犯罪和知識產(chǎn)權(quán)司法保護等各項保護知識產(chǎn)權(quán)工作有序進行。全省受理專利案件的中級法院數(shù)達(dá)到6個，居全國第二位。
Summary of Zhejiang Provincial Intellectual Property Protection in 2008
In 2008, Zhejiang Province promoted actively the implementation of the national Intellectual property strategies. The governments at different levels and concerned departments have further strengthened the IPR protection. The coverage and the exposal rate of IP work have been greatly upgraded and a sound situation of sustainable development has appeared.
I. Promoting the Implementation of the IP Strategies Comprehensively
The provincial people’s government issued the Action Plan of upgrading capability of Independent Innovation, and the Regulation for Management of Administrative Law Enforcement at Cultural Markets in Zhejiang Province, and the Regulation for Management of Copyrights in Zhejiang Province. Concerned departments at provincial level made out the Plan for Implementation of the Strategies of IP, Standardization and Branding, and the Opinions on Protecting and Promoting the Development of historic Brands in Zhejiang Province. The members of the provincial IP leading group have been added six departments, including the Publicity Department of CPC Provincial Committee and the Provincial Procuratorate, in order to complete the coordinative system for IP administration.
II. Motivating IP in Enterprises and Regions
The IP administrations evaluated and confirmed 1,656 demonstrative enterprises of patent at different levels, including 13 demonstration enterprises at the national level and 478 at the provincial level. Zhejiang Provincial Intellectual Property Administration evaluated and confirmed 19 counties (districts), in which, Xihu District in Hangzhou City was recognized as “IP Demonstration Counties (Districts) in Zhejiang Province” and Tongxiang Economic Development Zone as “IP Demonstration Zone in Zhejiang Province”. In 2008, the enterprises in our province took part in the establishment of 14 international standards, 438 national standards and 312 industrial standards. There are 289 famous China’s brands and 1,660 famous Zhejiang’s brands.
III. Strengthening the Construction of IP Culture
The system of IP offices in the province has spent more than 8 million RMB on promotion and more than 6 million RMB on training, increased by 10% and 30% respectively compared with last year. 441 training courses were held and 41,500 persons were trained. The cooperation and exchange of IP has been further developed.
IV. Strengthening IPR Protection
In 2008, the total amount of patent applications in Zhejiang province was 89，965 cases. The total amount of granted patents was 52,955 cases. There were 177 cases of PCT applications in Zhejiang province. There were 64 notices of exclusive right registration of Layout Design of Integrated Circuit. According to concerned clauses in the Regulation of Zhejiang Patent Protection, entrusted administrative law enforcement of patent has been launched in some counties (districts). In 2008, 18 new famous trademarks were added in Zhejiang province. There were 7,150 new international registrations of trademark and 48,000 trademarks newly registered. There were 4,131 pieces of software copyright registered in Zhejiang province. Five geographical indication products were newly added. The national standards of 11 geographical indication products were revised. The patent administrations launched special actions named “Thunder Storm” and “Sky Net” to inspect and supervise specially expositions, open markets and supermarkets. In the action, more than one hundred raids and inspections were organized and about 150 cases of patent disputes and complaints were filed, among which 44 cases went to investigation, 25 cases were concluded and more than 50 cases mediated. Cracking down IPR crimes by the public securities organs with the procuratorate organs, the judicial protection of IPR was pushed forward in order. Up to now, in Zhejiang province, there are six intermediate courts that were granted jurisdiction on the patent cases, which ranked second in the country.
